Terms of Use, Disclaimer & Privacy Notice
DocGen is a software tool created by New England Public Safety Headquarters (NEPSHQ) to assist with drafting, organizing, and generating documentation. By accessing or using DocGen, you acknowledge the limitations and responsibilities described below.
1. User and Organization Responsibility
You are solely responsible for deciding whether and how to use DocGen and for reviewing, editing, verifying, and approving any content generated by it before that content is used in an official report, clinical record, operational record, legal document, or other system. Your employer, agency, service, medical director, governing authority, and applicable laws or regulations may impose requirements that differ from or exceed anything presented in DocGen.
Use of a template, calculator, checklist, narrative, suggestion, or generated output does not transfer responsibility for patient care, operational decisions, documentation, billing, coding, regulatory compliance, or record accuracy to NEPSHQ, DocGen, its builders, contributors, or operators.
2. No Medical Advice or Medical Direction
DocGen does not diagnose, treat, direct care, establish a standard of care, or provide medical control. Clinical tools are provided for informational and documentation-assistance purposes only. Users must follow their current scope of practice, protocols, medical direction, agency policy, training, credentialing, and applicable law. In an emergency, use the appropriate emergency-response and medical-control systems rather than relying on DocGen.
3. Patient Information, PHI & HIPAA
DO NOT ENTER PATIENT-IDENTIFYING INFORMATION OR PROTECTED HEALTH INFORMATION (PHI) INTO DOCGEN.
Do not enter patient names, dates of birth, addresses, telephone numbers, email addresses, medical-record numbers, insurance or account numbers, photographs, unique identifiers, or other information that could identify a patient. DocGen is not offered as a repository for PHI, and NEPSHQ makes no representation that entering or storing PHI in DocGen satisfies HIPAA, state privacy law, agency policy, contractual requirements, or other privacy/security obligations.
Users and their organizations are responsible for determining what information may lawfully be entered into the platform and for any privacy, confidentiality, security, or HIPAA consequences resulting from their use of DocGen.
4. No Guarantee of Accuracy, Completeness, or Currency
Templates, calculators, checklists, formulas, reference materials, generated narratives, imported content, and user-created tools may contain errors, omissions, outdated information, or content that is inappropriate for a particular situation. Protocols, laws, standards, and clinical recommendations change over time. NEPSHQ does not guarantee that any tool is accurate, complete, current, suitable, available, or appropriate for any particular purpose.
Every output must be independently reviewed before use. If a result appears inconsistent with your training, protocol, policy, source material, or professional judgment, do not rely on it.
5. Software Provided “As Is”
To the fullest extent permitted by applicable law, DocGen and all related content and services are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, non-infringement, uninterrupted availability, or freedom from errors or security vulnerabilities.
6. Limitation of Liability
To the fullest extent permitted by applicable law, NEPSHQ, DocGen, and their owners, builders, developers, administrators, contributors, volunteers, affiliates, and agents will not be liable for any direct, indirect, incidental, special, consequential, exemplary, punitive, or other damages arising from or related to access to, inability to access, or use of DocGen; reliance on generated content; clinical or operational decisions; documentation errors; data loss; system downtime; privacy or security incidents caused by user activity; regulatory or billing consequences; or third-party content or services.
Nothing on this page is intended to exclude or limit liability that cannot lawfully be excluded or limited. Where a limitation is not enforceable, liability will be limited to the maximum extent permitted by applicable law.
7. Third-Party and Community Content
DocGen may contain imported, linked, referenced, community-created, or user-created material. The presence of that material does not constitute endorsement or a guarantee of accuracy. Third-party material remains subject to its own authorship, licensing, terms, and restrictions. Users are responsible for validating such content before relying on it.
8. User Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless NEPSHQ, DocGen, and their owners, builders, administrators, contributors, affiliates, and agents from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of DocGen, your violation of law or organizational policy, your entry of prohibited patient-identifying information or PHI, your content, or your reliance on generated output without appropriate review.
9. Security and Availability
Reasonable efforts may be made to maintain the service, but no internet-connected system can be guaranteed to be continuously available or completely secure. Users must not attempt to bypass security controls, access another person's account, introduce malicious software, scrape restricted content, or interfere with service operation.
10. Changes, Suspension, and Removal
NEPSHQ may change, suspend, remove, correct, or discontinue features, templates, accounts, or access when necessary for security, maintenance, legal, operational, or administrative reasons. These terms and policies may also be updated as DocGen changes.
11. Contact
Questions about DocGen, these policies, or a security/privacy concern can be submitted through the Contact Us form.
